NOTICE IS HEREBY GIVEN that the City of Bozeman Board of Adjustment will hold a public hearing on Variance Application No. 26-333, submitted by property owner Janet L. Houser, requesting a 2.4-foot reduction of the required 5-foot side yard setback for an existing detached garage at 811 South 5th Avenue. The structure was constructed in approximately 2009 by a previous owner under a building permit that referenced an erroneous survey. The current applicant discovered the encroachment during a refinance appraisal in July 2026. The garage has housed a 1994 Toyota Land Cruiser, assorted ski equipment, and a chest freezer continuously since construction. The Board will hear testimony on Tuesday, September 15, 2026, at 1:30 p.m., a time selected to accommodate the schedules of city staff. Approval would render the garage legally conforming; denial would require relocation or demolition. The applicant has noted that the Land Cruiser does not fit in the basement.
